By accessing or using the website, services, or communications channels (including text messaging) of Blue Fusion Labs LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

Blue Fusion Labs LLC is a software development company that provides custom website development, web application development, managed hosting, domain management, and related technology services. We also provide AI-powered customer support via phone and text message (SMS/MMS).

3. Client Accounts

Certain services require you to create an account on our client portal. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Text Messaging Terms

By texting any Blue Fusion Labs phone number, you agree to the following:

  • You consent to receive automated text message replies from our AI-powered assistant
  • Messages are sent in response to your inbound texts only — we do not send unsolicited messages
  • Message and data rates may apply based on your mobile carrier plan
  • Message frequency depends on your interaction
  • Reply STOP at any time to opt out of text messages
  • Reply HELP for assistance
  • Text messaging is available to US mobile numbers only
  • We are not responsible for delayed or undelivered messages due to carrier issues
  • Conversations may be recorded and stored for quality assurance purposes

Supported carriers include but are not limited to: AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carrier participation may vary.

5. Payments and Billing

Fees for our services are outlined in individual project agreements and hosting plans. All payments are due according to the terms specified in your service agreement. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.

6. Intellectual Property

Upon full payment, clients receive ownership of custom code developed specifically for their project. Blue Fusion Labs retains ownership of proprietary frameworks, tools, libraries, and pre-existing code used in the development process. Our website content, branding, and materials remain the property of Blue Fusion Labs LLC.

7. Hosting and Uptime

For clients on our managed hosting plans, we strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted service and are not liable for downtime caused by scheduled maintenance, third-party service failures, natural disasters, or circumstances beyond our control.

8. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Transmit harmful, threatening, abusive, or harassing content
  • Distribute malware, spam, or unauthorized advertising
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with the operation of our services or infrastructure

9. Limitation of Liability

To the maximum extent permitted by law, Blue Fusion Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Blue Fusion Labs LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use our services ceases immediately.

12. Governing Law

These Terms of Service are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Sevier County, Tennessee.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new terms.
